..No blood money should be given to the family of who killed himself
In the name of Allah the All Merciful, the Most Merciful, prayer of forgiveness and peace be upon the seal of prophets and messengers; Mohammad messenger of Allah, and his virtuous righteous family, and all believers, then after this..
Answer to the questioners and fatwa with truth; a fact that I do not speak about Allah’s (law) except the truth. Indeed, no blood money should be given to the family of the one who killed himself. Confirming with the word of Allah the Most High: {And no burdened soul can bear another’s burden. And if one weighed down by a burden calls another to carry his load, not a thing of it will be carried, even though he is near of kin. You warn only those who fear their Lord in secret and keep up prayer. And whoever purifies himself, purifies himself only for his own good. And to Allah is the eventual coming.}Truthful Allah the Great [Faater] 35:18
{ وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَىٰ ۚ وَإِن تَدْعُ مُثْقَلَةٌ إِلَىٰ حِمْلِهَا لَا يُحْمَلْ مِنْهُ شَيْءٌ وَلَوْ كَانَ ذَا قُرْبَىٰ ۗ إِنَّمَا تُنذِرُ الَّذِينَ يَخْشَوْنَ رَبَّهُم بِالْغَيْبِ وَأَقَامُوا الصَّلَاةَ ۚ وَمَن تَزَكَّىٰ فَإِنَّمَا يَتَزَكَّىٰ لِنَفْسِهِ ۚ وَإِلَى اللَّهِ الْمَصِيرُ ﴿١٨﴾ } صدق الله العظيم [ فاطر ].
For example: a person got in a car, whether in the cabin or the trunk of the car, whether the driver of the car knew that the person was riding the car or not, and while the car was traveling on the road, a person jumped from it to the ground and died, so it is not permissible to charge the car driver anything of the blood money (neither a dirham nor a dinar), since the blood money for wrongful killing in the decisive grand Quran is the unintentional wrongful killing of the killer in Allah’s decisive Book the grand Quran. As for that, the passenger being in the car then jumped off the car during its movement with the intention of the passenger, surely this is an intentional suicide from the passenger. Or the naughty youth jumped in the back of the car as it was going and no one kidnapped him; Rather, out of his own free will, he got into the car and while it was moving he jumped off and hit the ground and died without asking the driver to stop to get off. By what right is the driver charged with blood money?! The fact there is no wrongful killing in the case by the driver at all, rather the offender against himself is the deceased alone; he is the only one who deliberately got out of the car while it was moving, or a naughty youth, so who is this one that issued a fatwa for the soul of the one who deliberately drop off of the car?!
So according to the question of the inquirer that the naughty youth got into the car’s trunk without the knowledge of the driver, and during the car’s movement while traveling on the road, so this youth jumped out of it and died. Then we confirm and say: Even though the driver knew about the passenger yet he did not request from the driver to stop (the car) to get out, rather he jumped off while the car was moving. Surely this naughty youth has killed himself and committed an offence against himself and himself alone. And the driver does not bear a burden of his (sin of the youth), certainly the driver did not kill him.
Oh, what a wonder! Where is the wrongful killing by the driver in this matter? The fact is, the blood money given to his family is centered on the wrongful killing by the driver. The question for the second time: Where is the wrongful killing in this incident if you do justice? Indeed, by what right they charge the driver (fine of) the blood money to be given to the family of the naughty youth or the man who committed suicide, to the fact he who offended against himself?! And no burdened soul can bear another’s burden. Certainly, it is not permissible in Allah’s decisive Book the grand Quran to make the car driver to bear the blood money of the wrongful killing because in this presented case for a response, I did not find a wrongful killing by the driver, in fact, the case is a case of suicide or naughtiness, so the car driver has no atom’s weight of sin.
O possessors of understanding minds, keep your duty to Allah and rule by what Allah sent down in the decisive Book. Indeed, Allah’s judgement in His decisive Book the grand Quran; definitely comes supported by reason and logic for the fact the mind is not blind to see the truth if using it is accomplished, so always you find the mind stands by the side of truth and logic, to the fact the mind makes him always see it and acknowledge it logically. Indeed, the mind is the wisdom itself if using the mind is accomplished. Confirming with the word of Allah the Most High: {He grants wisdom to whom He pleases. And whoever is granted wisdom, he indeed is given a great good. And none mind but those of understanding.}Truthful Allah the Great [Al-Baqarah] 2:269
{ يُؤْتِي الْحِكْمَةَ مَن يَشَاءُ ۚ وَمَن يُؤْتَ الْحِكْمَةَ فَقَدْ أُوتِيَ خَيْرًا كَثِيرًا ۗ وَمَا يَذَّكَّرُ إِلَّا أُولُو الْأَلْبَابِ ﴿٢٦٩﴾ } صدق الله العظيم [ البقرة ].
